Terms of Service

These Terms govern your use of the NityaHR platform.

1. Acceptance

By using the platform on behalf of an organisation, you confirm authority to bind that organisation.

2. Subscription & plans

• Plan tiers and pricing are listed on our pricing page.
• Subscriptions auto-renew unless cancelled.
• Free plan is provided as-is with no SLA.

3. Acceptable use

• No illegal content or content that violates third-party rights.
• No reverse engineering.
• No reselling without written agreement.

4. Your data, your responsibility

You retain ownership of uploaded data. We act only as Data Processor.

5. Service availability

• Free: best-effort.
• Pro: 99.5% monthly uptime.
• Enterprise: 99.9% monthly uptime with contractual SLA available.

6. Limitation of liability

To the maximum extent permitted by Indian law, our aggregate liability is limited to fees paid in the 12 months preceding the claim. No liability for indirect / consequential / punitive damages.

7. Termination

You can cancel anytime. We may suspend accounts for material breach. Data exportable for 30 days post-termination.

8. Statutory compliance disclaimer

We automate Indian statutory calculations (PF / ESI / TDS / LWF) on best-effort basis. Final responsibility for filing accuracy is the Customer's. Validate with your CA.

9. Governing law

Indian law. Disputes resolved in the courts of Lucknow, Uttar Pradesh.
